Terms and Conditions for the Provision of Electronic Services

INTRODUCTION

Pursuant to the provisions of the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws of 2024, item 1513, consolidated text of 14 October 2024), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (Official Journal of the European Union L 119, p. 1), hereinafter referred to as the “GDPR”, and the Act of 12 July 2024 – Electronic Communications Law, the Service Provider hereby introduces these Terms and Conditions, which specify in particular the types and scope of services provided electronically, the terms and conditions for the provision of such services, including technical requirements and the prohibition on providing unlawful content, the terms and conditions for entering into and terminating agreements for the provision of electronic services, as well as the complaints procedure.

Chapter 1

General Provisions

Definitions of terms used in these Terms and Conditions:

Service Provider – SkySnap sp. z o.o., al. Jerozolimskie 81, 02-001 Warsaw, Poland, Tax Identification Number (NIP): 5223040482, REGON: 362701268.

The Service Provider may be contacted by e-mail at: kontakt@skysnap.pl or in writing by sending correspondence to: al. Jerozolimskie 81, 02-001 Warsaw, Poland, tel. +48 732 145 436.

Website – the Service Provider’s website through which the Services are provided: https://skysnap.pl/

Service – a service provided electronically, performed by sending and receiving data via ICT systems at the individual request of the Service Recipient, without the simultaneous physical presence of the parties, where such data is transmitted through public networks (the Internet). The Service Provider offers the following Services:

  • Newsletter,
  • Contact Form,
  • Webinar,
  • Chat,
  • SkySnap Portal.

Service Recipient – any entity using the Services provided by the Service Provider, which is a party to an agreement for the provision of electronic services and which, by using the Services, agrees to comply with and accepts these Terms and Conditions.

Chapter 2

Newsletter

The Controller provides the Newsletter service electronically.

The Newsletter service consists of sending information concerning offers, promotions and events related to the Service Provider’s activities to the e-mail address provided by the User. The Controller notes that the Newsletter will not be sent at regular intervals (e.g. monthly). Newsletter distribution will depend on promotional activities undertaken by the Service Provider and will therefore be irregular.

The Newsletter service may be provided via:

  • e-mail,
  • SMS/MMS messages,
  • telephone calls,
  • WhatsApp.

The Service is provided free of charge for an indefinite period, until consent is withdrawn or until the Service Provider discontinues the Newsletter.

The Service Recipient consents to receiving the Newsletter by providing their contact details for this purpose. Consent to receiving commercial information from the Service Provider by means of electronic communication is granted by ticking the relevant checkbox and is subject to the applicable marketing communication rules.

Chapter 3

Contact Form

The Service Provider provides a service consisting of responding to questions relating to its services, customer support, terms of cooperation, including requests for pricing information, and similar enquiries.

Questions may be submitted through the Contact Form. For this purpose, it is necessary to provide the subject of the enquiry, e-mail address, first and last name, enter the content of the message and click the “Send message” button. Failure to provide an e-mail address will prevent the Service Provider from sending a response to the Service Recipient’s enquiry.

The Service Provider will use reasonable efforts to respond to an enquiry within no more than 2 days, excluding Saturdays and statutory public holidays.

Chapter 4

Webinar

The Webinar Service is provided in the form of remote expert lectures.

Webinars are provided free of charge.

Participation in a Webinar requires registration and the provision of the following data: first and last name, telephone number, e-mail address, company name and, optionally, area of business activity.

The scope of each Webinar is specified in the participation terms available on the relevant Webinar page. Where the provisions of the participation terms differ from the provisions of this Chapter, the participation terms shall prevail.

Chat

The Service Provider provides the Chat service electronically, enabling the Service Recipient to contact the Service Provider in real time via a chat window available on the Website.

The Chat service is intended to provide basic information concerning the Service Provider’s services, terms of cooperation, functionalities of the solutions offered and initial handling of enquiries submitted by Service Recipients.

Use of the Chat service may require the Service Recipient to provide selected data, in particular their name, e-mail address or telephone number, where necessary for handling the enquiry or providing a response.

The Chat service is auxiliary and informational in nature and does not constitute a channel for submitting complaints unless the Service Provider expressly states otherwise.

The Service Provider reserves the right to provide responses through the Chat either automatically or through an authorised representative of the Service Provider.

The Chat service is provided free of charge and is available while the Website is operational, subject to technical or maintenance interruptions and limitations resulting from staff availability.

The Service Recipient is required to use the Chat service in compliance with applicable law, generally accepted standards of conduct and these Terms and Conditions, and in particular must not provide unlawful content.

Chapter 5

Processing Service

The terms and conditions for the provision and use of the professional photogrammetric data processing service, involving data submitted by the Client to a storage location made available by the Contractor, are set out in the Processing Service Terms and Conditions.

Chapter 6

SkySnap Portal

The terms and conditions for the provision and use of the SkySnap Portal are set out in the Website Terms and Conditions.

Chapter 7

Obligations of the Service Recipient

The Service Recipient is prohibited from providing unlawful content.

The Service Recipient is required to use the Service Provider’s Website and the Services offered in compliance with applicable law, generally accepted standards of conduct and these Terms and Conditions, using accurate and truthful information and refraining from any conduct contrary to these Terms and Conditions.

The Service Recipient is required to maintain confidentiality and not disclose to third parties any information obtained in connection with the provision of Services by the Service Provider, including commercial, organisational, technological and financial information.

Chapter 8

Complaints Procedure

The Service Provider shall exercise due care to ensure that the Services are provided in accordance with these Terms and Conditions, applicable law and appropriate information security standards.

Complaints relating to the provision of the Services or operation of the Website may be submitted in writing to the Service Provider’s postal address or electronically by e-mail to the Service Provider’s e-mail address.

A complaint should contain information concerning the circumstances giving rise to the complaint, in particular the type and date of the irregularity, the Service Recipient’s request and their contact details.

The Service Recipient is required to submit a complaint within 14 days from the date on which the irregularity occurred, failing which the Service Recipient may lose any claims against the Service Provider arising from such irregularity.

The Service Provider shall review complaints without undue delay and no later than within 14 days of receipt. If a complaint cannot be reviewed within this period, the Service Provider shall inform the complainant within that period of the reasons for the delay and of the expected additional time required to resolve the complaint.

Chapter 9

Technical Requirements Necessary for Compatibility with the ICT System Used by the Service Provider

The technical requirements necessary to use the Service Provider’s Website include: Internet access; a device capable of accessing the Internet, such as a desktop computer, laptop or other portable device equipped with a web browser; access to e-mail and a properly configured e-mail account; and any properly configured version of a web browser supporting, among other things, cookies, including Internet Explorer, Opera, Mozilla Firefox, Safari or Google Chrome.

Despite the security measures implemented by the Service Provider to prevent or significantly hinder unauthorised access to its systems, including hacking attacks, the use of Services over the Internet may involve a risk of unwanted infection of an IT system with malicious software. The Service Provider therefore additionally recommends using up-to-date antivirus software and an appropriate firewall.

Chapter 10

Personal Data Processing in Connection with the Provision of Services

The Service Provider provides electronic services in accordance with these Terms and Conditions.

The rules governing the processing of personal data in connection with the provision of the Services are set out in the Privacy Policy.

Chapter 11

Transitional and Final Provisions

These Terms and Conditions are effective as of 7 August 2026.

The Service Provider reserves the right to amend these Terms and Conditions unilaterally for valid reasons, including in particular changes in applicable law to the extent that such changes affect the implementation of these Terms and Conditions.

Any amendments shall enter into force upon publication of the amended Terms and Conditions online on the Service Provider’s Website.

The Service Provider has the right to temporarily suspend or restrict the provision of the Services in exceptional circumstances affecting the security or stability of the Website or where necessary maintenance work is required, provided that the Service Recipient is informed in advance. In urgent cases, the Services may be temporarily suspended or restricted without prior notice to the Service Recipient.

Where the Service Recipient uses the Services in a manner contrary to generally applicable law, generally accepted standards of conduct or these Terms and Conditions, including by providing, through or to the Service Provider’s Website, content that is unlawful, false, vulgar, infringes the rights or personal interests of third parties, copyright or intellectual property rights, or generally accepted social norms, the Service Provider shall have the right to remove such content, terminate the agreement for the provision of the Services and take any measures provided for by law.
